Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Whispy AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding legal agreement between you and NEXBASE TECH PTE. LTD. ("we," "us," or "our").

2. Eligibility

You must be at least 17 years of age to use Whispy AI. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Description of Service

Whispy AI provides an AI-powered companion chat experience. The AI companions are fictional entities generated by artificial intelligence and are not real people. Interactions with AI companions are for entertainment and emotional support purposes only and do not constitute professional advice of any kind, including medical, psychological, legal, or financial advice.

4. User Conduct

You agree not to use the App to:

Generate, distribute, or store illegal, harmful, or abusive content.
Attempt to reverse-engineer, scrape, or exploit the AI systems.
Impersonate any person or entity or misrepresent your affiliation.
Violate any applicable local, national, or international law or regulation.
Harass, threaten, or harm other users or our staff.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, AI models, and software — are the exclusive property of NEXBASE TECH PTE. LTD. and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

6. Subscriptions & Payments

Whispy AI may offer premium features through in-app purchases or subscription plans. All payments are processed through Apple's App Store. Subscription fees are billed in advance and are non-refundable except as required by applicable law or Apple's refund policies. You can manage or cancel subscriptions through your Apple ID account settings.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure. AI-generated responses may be inaccurate or inappropriate; always use your own judgment.

8. Limitation of Liability

To the maximum extent permitted by law, NEXBASE TECH PTE. LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.

9. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes via in-app notification or email. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
